Terms of Service | Atlas Media Group LLC

1. Acceptance of terms

By accessing or using services provided by Atlas Media Group LLC (“Atlas,” “we,” “our,” or “us”), you agree to be bound by these Terms of Service. If you do not agree, you may not use our services.

2. Services provided

Atlas Media Group provides, but is not limited to:

Website design and development
App development and engineering services
Performance marketing (Meta, Google, TikTok, email, SMS)
Creative services (design, content, branding)
AI and automation integrations
Consulting and strategy services
Whatnot-related services (thumbnails, repacks, branding, content)

All services are customized per client agreement.

3. Client responsibilities

You agree to:

Provide accurate and complete information
Supply required assets (logos, content, credentials, etc.)
Respond in a timely manner to requests
Ensure you have rights to all materials provided

Atlas is not responsible for delays caused by lack of client communication or materials.

4. Payments & fees

All fees are outlined in project agreements, invoices, or proposals
Payments may be required upfront, milestone-based, or recurring
Late payments may result in paused work or service suspension
All payments are non-refundable unless explicitly stated

5. Turnaround & delivery

Timelines are estimates and may vary based on scope and client responsiveness. Expedited services (e.g. 72-hour website builds) depend on timely client input. Atlas is not liable for delays caused by third-party platforms or integrations.

6. Intellectual property

Upon full payment, clients receive rights to final deliverables. Atlas retains the right to display work in its portfolio and to reuse non-proprietary frameworks, systems, and templates. Third-party tools, plugins, or software remain the property of their respective owners.

7. Performance disclaimer

Atlas does not guarantee specific results including revenue, ROAS, lead volume, or conversion rates. Marketing and business outcomes depend on multiple external factors beyond our control.

8. Third-party platforms

We may integrate or work with Meta (Facebook/Instagram), Google, TikTok, Shopify, Whatnot, and various CRM and software tools. Atlas is not responsible for platform outages, account bans or restrictions, or policy changes.

9. Limitation of liability

To the fullest extent permitted by law, Atlas Media Group shall not be liable for indirect or consequential damages, loss of revenue, profits, or data, or business interruption. Our total liability shall not exceed the amount paid for services.

10. Termination

We reserve the right to terminate services at any time for breach of agreement and to suspend services for non-payment. Clients may terminate services based on agreed terms but are responsible for all work completed.

11. Confidentiality

Both parties agree to keep confidential all business information, strategies, and proprietary systems, unless disclosure is required by law.

12. Governing law

These Terms are governed by the laws of the State of New York.

13. Changes to terms

We may update these Terms at any time. Continued use of services constitutes acceptance.
